Brian Smiley is a partner in the Atlanta law firm of Smiley Bishop & Porter LLP. For over twenty years in private practice, Mr. Smiley has concentrated his practice in the securities field, primarily representing investors in arbitrations hearings before the New York Stock Exchange and the Financial Industry Regulatory Authority ("FINRA"). Mr. Smiley also serves as a FINRA appointed arbitrator.
Mr. Smiley is the author of numerous articles about broker misconduct and arbitration including: "Stockbroker-Customer Disputes-Making a Case for Arbitration," (Georgia State Bar Journal, May 1987); "Spotting Common Forms of Stockbroker Misconduct" (The Verdict, Jan.- Feb. 1991); and, "The Law and Ethics of Witness Preparation" (Practicing Law Institute, 1998); and "Breaking the Nest Egg: Using Traditional Theories to Handle New Cases" (Practicing Law Institute, 2007).
Mr. Smiley frequently lectures on the topic of investment disputes and has also spoken at seminars sponsored by the Public Investors Arbitration Bar Association ("PIABA"), the Practicing Law Institute, the Association of the Bar of the City of New York, and the Georgia Institute For Continuing Legal Education. He has testified as an expert at special hearings concerning securities fraud conducted by the Secretary of State of Georgia and the United States Senate Committee on Banking, Housing and Urban Affairs.
Mr. Smiley has held several leadership positions in organizations focused on securities and investment dispute resolution. Mr. Smiley is the 2008-2009 President Elect of the Public Investors Arbitration Bar Association. From 2002 to 2007, Mr. Smiley served as a public member of the National Arbitration and Mediation Committee ("NAMC") of FINRA. The NAMC is involved in the drafting of arbitration rules and the recruitment, training and evaluation of arbitrators. Mr. Smiley has served as Chairman of the NAMC's Rules & Procedures Subcommittee. He was recently appointed as the Co-Chair of the Securities Arbitration Subcommittee of American Bar Association.
Mr. Smiley grew up in Atlanta and, in 1975, graduated from Emory College with highest honors. He then attended Emory University School of Law, where he served on the Emory Law Journal. After graduating from law school (with honors) in 1978, Mr. Smiley was appointed as a Trial Attorney in the U.S. Department of Justice in Washington, D.C. Mr. Smiley represented the United States in Nixon v. U.S., and other cases involving significant constitutional, statutory and treaty-related issues.
